By accessing or using the Website, creating an account, placing an order, or clicking to accept or agree to these Terms when that option is made available to you, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. IMPORTANT NOTICE REGARDING DISPUTE RESOLUTION: THESE TERMS CONTAIN A MANDATORY ARBITRATION PROVISION AND A CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS. BY AGREEING TO THESE TERMS, YOU AGREE TO RESOLVE DISPUTES WITH R3TA LLC THROUGH BINDING INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR OTHER REPRESENTATIVE PROCEEDINGS.
2. Definitions
2.1. "Account" means the registered user account created by a User to access certain features of the Website and Services.
2.2. "Company" refers to R3TA LLC, its affiliates, and subsidiaries.
2.3. "Content" means all text, graphics, images, logos, photographs, audio, video, data compilations, software, code, and other materials appearing on or available through the Website.
2.4. "Products" refer to peptide therapies, health and wellness products, telehealth services, compounded products, supplements, and any other goods or services offered for sale on or through the Website. Products are provided in accordance with applicable prescriptions and clinical oversight by a Healthcare Provider where required by law.
2.5. "Healthcare Provider" refers to the independent, licensed physician, nurse practitioner, or other qualified healthcare professional who reviews your health information and, where applicable, prescribes or authorizes Products in compliance with applicable law.
2.6. "Telehealth Services" means any remote clinical consultation, health intake review, or medical assessment facilitated through the Website or a third-party telehealth platform in connection with the Services.
3. Eligibility and Account Registration
3.1. Age Requirement. 4.1. No Traditional Doctor-Patient Relationship. R3TA is not a Healthcare Provider and does not provide medical services directly. Accessing the Website or Services does not create a doctor-patient relationship between you and R3TA. To the extent that telehealth consultations are facilitated through the Website or a third-party platform, such consultations are provided by independent, licensed Healthcare Providers who are not employees or agents of R3TA.

4.3. No Medical Claims. R3TA does not make any medical claims regarding its Products. Statements on this Website have not been evaluated by the U.S. Food and Drug Administration ("FDA") or any other regulatory body. Products offered through this Website are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Any claims regarding the potential benefits of peptides or other Products are based on preliminary or emerging research and should not be construed as definitive or conclusive.
4.4. Compounded Products Disclaimer. Certain Products available through the Website may be compounded medications prepared by licensed 503A or 503B compounding pharmacies. All peptide Products offered through R3TA are sourced exclusively from FDA-registered 503B outsourcing facilities operating under current Good Manufacturing Practice (cGMP) standards and located within the United States. Compounded products are not FDA-approved. This means the FDA does not review these products for safety, efficacy, or quality before they reach consumers. Product images on the Website are for display purposes only and may not reflect actual product appearance.
4.6. Voluntary Participation and Assumption of Risk. You acknowledge and agree that all participation in the Services and use of Products is voluntary and undertaken at your own risk. You assume full responsibility for any and all outcomes, including health-related effects, adverse reactions, or unintended consequences. You are solely responsible for disclosing all relevant health information to any Healthcare Provider associated with the Services.
5. Products, Descriptions, and Disclaimers
5.1. Product Accuracy. R3TA strives to describe and display its Products accurately on the Website. However, we do not warrant that product descriptions, images, pricing, specifications, or other content on the Website are accurate, complete, reliable, current, or error-free. In the event a Product is described inaccurately, mispriced, or is unavailable, we reserve the right to correct errors, update information, or cancel orders at any time without prior notice.
5.2. Third-Party Products and Pharmacy Partners. R3TA is not a manufacturer or compounder of pharmaceutical products. All compounded Products are sourced from independent manufacturers that include licensed third-party 503A and/or 503B compounding pharmacies ("Pharmacy Partners" and together with research only manufacturers, each a " Manufacturing Partner"). R3TA does not assume liability for manufacturing defects, compounding errors, or the quality or efficacy of Products produced by Manufacturing Partners. Manufacturing Partners are independent entities responsible for compounding and dispensing in accordance with their own terms, policies, and applicable federal and state laws.
5.3. No Warranty. ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT. R3TA DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
6. Ordering, Payment, and Billing
6.1. Order Acceptance. All orders placed through the Website constitute an offer to purchase. R3TA reserves the right, with or without prior notice, to: (a) limit the available quantity of or discontinue any Product or Service; (b) impose conditions on the use of any coupon, promotional code, or similar promotion; (c) bar any User from completing any transaction; and (d) refuse to provide any User with any Product or Service for any lawful reason, including suspected fraud, regulatory compliance concerns, or violations of these Terms.
6.2. Pricing and Taxes. All prices are listed in U.S. dollars and do not include applicable taxes, shipping, or handling fees unless otherwise stated. Taxes and shipping charges will be calculated and displayed at checkout prior to payment authorization. R3TA reserves the right to change prices at any time without prior notice.
6.3. Payment. Payment must be made in full at the time of purchase using an accepted payment method as displayed at checkout. By providing payment information, you represent and warrant that you have the legal right to use the payment method provided and that the information you supply is accurate. You authorize R3TA to charge the applicable fees to your designated payment method.
6.4. Membership and Recurring Charges. If you enroll in a membership, subscription, or recurring billing plan, you authorize R3TA to charge the applicable recurring fees to your payment method at the intervals specified at the time of enrollment. You may cancel your membership or subscription in accordance with the cancellation procedures described on the Website or by contacting customer support. Refunds for unused membership periods are not provided except at the Company's sole discretion or as required by applicable law.
6.5. Chargebacks and Disputes. The Company maintains comprehensive electronic records of each transaction, including order details, payment authorization, shipment tracking, and carrier delivery confirmation. Chargebacks initiated without a good-faith effort to resolve the issue directly with R3TA may constitute a breach of these Terms. R3TA reserves the right to dispute any chargeback that is inaccurate, fraudulent, or unsupported and to seek recovery of reasonable, documented costs including processor-imposed fees and administrative expenses to the extent permitted by applicable law. Repeated or abusive chargeback activity may result in account suspension or termination.
7. Cancellations and Refunds
7.1. Cancellation Before Shipment. You may request cancellation of an order before it has been processed and shipped by contacting us at support@r3ta.com. If the order has not yet been processed, a full refund will be issued to the original payment method.
7.2. Cancellation After Shipment. Once an order has been shipped, it cannot be canceled. You may, however, be eligible for a return and refund in accordance with Section 7.3 below.
7.3. Returns and Refunds. Due to the nature of our Products, our return and refund policy is as follows:
- (a) Prescription medications cannot be returned once dispensed, as required by applicable pharmacy law and regulations.
- (b) Unopened, non-prescription Products in their original, sealed packaging may be eligible for return within thirty (30) days of delivery.
- (c) Products that are defective, damaged during shipping, or incorrectly fulfilled must be reported to us within seven (7) days of delivery with photographic documentation and your order number.
- (d) Approved refunds will be processed within ten (10) business days after the returned product is received or the issue is validated, and will be credited to the original payment method.
- (e) Shipping costs are non-refundable unless the return is due to our error.
- (f) R3TA reserves the right to deny any return or refund request where there is evidence of tampering, misuse, improper storage, or product degradation after delivery.
7.4. Store Credit. In situations where an approved refund cannot be processed due to payment-processor rules or the User's selected payment method, the Company may issue store credit equal to the original purchase amount. Store credits are non-transferable and expire twelve (12) months from the date of issuance unless otherwise required by applicable law.
8. Shipping and Delivery
8.1. Shipping Terms. Domestic shipping options are available as displayed at checkout. Shipping costs and estimated delivery times vary based on destination, carrier, and shipping method selected. All delivery times provided by carriers are estimates only and are not guaranteed.
8.2. Processing Time. Orders are processed and shipped within standard business hours, generally Monday through Friday, excluding holidays. Orders placed and paid for after the daily processing cutoff will be shipped the following business day.
8.3. Risk of Loss and Title Transfer. Ownership of and risk of loss for Products transfers to you upon the carrier's confirmed delivery to the shipping address you provided, provided that R3TA has properly packaged the order, supplied accurate shipping information, and selected a commercially reasonable carrier. After carrier-confirmed delivery, R3TA is not responsible for theft, loss, misdelivery, or other post-delivery issues. You are responsible for ensuring a secure delivery location.
8.4. Shipping Insurance. If offered at checkout, you may opt in to shipping insurance to protect against loss, damage, or incorrect deliveries during transit. Insurance must be selected at the time of purchase and cannot be added retroactively. Without shipping insurance, R3TA is not liable for lost, damaged, delayed, or misdelivered shipments once transferred to the carrier, except to the extent such loss results from the Company's gross negligence or willful misconduct.
8.5. Carrier Delays. R3TA is not responsible for delays caused by the carrier after shipment has been accepted and processed, including delays caused by weather, carrier errors, regional disruptions, or other factors outside our control.
8.6. Undeliverable Shipments. R3TA reserves the right to charge you for shipping fees to re-ship any Products that have been returned to us due to shipment refusal, insufficient or inaccurate address, or Products that are otherwise undeliverable.
9. Privacy and Data Use
9.1. Privacy Policy. Your use of the Website and Services is subject to our Privacy Policy, which describes how we collect, use, disclose, and safeguard your personal information. By using the Website, you consent to the collection and use of your information as described in our Privacy Policy.
9.2. Data Collection. 9.3. Health Information. 9.4. Third-Party Service Providers. You may opt out at any time by replying "STOP" to any message. Message frequency varies. Standard message and data rates may apply. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
10. Intellectual Property
10.1. Ownership. The Website and its entire Content — including but not limited to text, graphics, photographs, logos, trademarks, trade names, button icons, images, audio and video clips, databases, data compilations, software, and code — are the exclusive property of R3TA, its affiliates, its licensors, or other content providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. All rights not expressly granted herein are reserved.
10.2. Limited License. Subject to your compliance with these Terms, R3TA grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Website and Content for personal, non-commercial purposes only. You may not: (a) modify, copy, reproduce, distribute, or create derivative works based on any Content; (b) use any Content for commercial purposes or public display without prior written consent; (c) remove, alter, or obscure any copyright, trademark, or other proprietary notices; (d) attempt to decompile, reverse engineer, or disassemble any software or technology used on the Website; or (e) use any data mining, robots, or similar data gathering and extraction tools.
10.3. Trademarks. The R3TA name, logo, and all related names, product and service names, designs, and slogans are trademarks of R3TA or its affiliates. You must not use these marks without prior written permission. All other trademarks, trade names, and logos appearing on the Website are the property of their respective owners.
10.4. Feedback. If you provide any feedback, suggestions, or ideas regarding the Website or Services ("Feedback"), you hereby grant R3TA an unrestricted, perpetual, irrevocable, non-exclusive, fully-paid, royalty-free right to use such Feedback in any manner and for any purpose, including to improve the Website and develop new products and services.
10.5. DMCA Notice. If you believe that any content on the Website infringes your copyright, please submit a notice in accordance with the Digital Millennium Copyright Act ("DMCA") to our designated copyright agent at support@r3ta.com. Your notice must include: (a) identification of the copyrighted work(s) claimed to be infringed; (b) identification of the allegedly infringing material and information sufficient to locate it; (c) your contact information; (d) a statement of good-faith belief that the use is unauthorized; and (e) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner.
11. Prohibited Conduct
You agree not to engage in any of the following prohibited activities in connection with the Website or Services:
- (a) Using the Website or Products for any purpose that violates any applicable federal, state, or local law or regulation;
- (b) Providing false, misleading, or inaccurate information when creating an Account, placing an order, or submitting health intake forms;

12. Limitation of Liability
12.1. Exclusion of Damages. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL R3TA LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, OR SUPPLIERS (COLLECTIVELY, THE "R3TA GROUP") BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO: (A) YOUR USE OF OR INABILITY TO USE THE WEBSITE, PRODUCTS, OR SERVICES; (B) ANY MEDICAL RECOMMENDATIONS, ADVICE, OR TREATMENT PROVIDED BY HEALTHCARE PROVIDERS AFFILIATED WITH OR ACCESSED THROUGH THE SERVICES; (C) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OR IN CONNECTION WITH THE WEBSITE; (D) ANY PRODUCT DEFECT, ADVERSE REACTION, OR INJURY RESULTING FROM PRODUCTS MANUFACTURED OR COMPOUNDED BY PHARMACY PARTNERS OR ANOTHER MANUFACTURER PARTNER; OR (E) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF R3TA LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12.2. Aggregate Liability Cap. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE R3TA GROUP'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS, THE WEBSITE, PRODUCTS, OR SERVICES WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE SHALL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS (USD $100.00).
12.3. Exceptions. Nothing in these Terms shall limit liability for (a) death or personal injury caused by gross negligence or willful misconduct; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable law.
12.4. California Residents. If you are a California resident, you hereby waive California Civil Code Section 1542, which provides: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
13. Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the R3TA Group from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and expert fees) arising out of or related to: (a) your access to or use of the Website, Products, or Services; (b) your violation of these Terms or any applicable law, regulation, or third-party right; (c) your negligence or willful misconduct; (d) any misuse, unauthorized use, or unintended application of Products; (e) your failure to follow Product instructions, recommended guidelines, or the advice of a Healthcare Provider; (f) your failure to disclose relevant health information in connection with the Services; (g) any content or information you submit through the Website; or (h) any dispute between you and a third party, including any Healthcare Provider or Manufacturing Partner.
14. Dispute Resolution
14.1. Informal Resolution. Before initiating any formal dispute resolution proceeding, you agree to first contact R3TA at support@r3ta.com and attempt to resolve any dispute informally for a period of at least thirty (30) days. Most concerns can be resolved quickly through informal discussion.
14.2. Binding Arbitration. If a dispute cannot be resolved informally within thirty (30) days, you and R3TA agree that all disputes, claims, or controversies arising out of or relating to these Terms, the Website, Products, Services, or the breach, termination, enforcement, interpretation, or validity thereof — including the determination of the scope or applicability of this agreement to arbitrate — shall be resolved by binding individual arbitration administered by JAMS pursuant to JAMS Streamlined Arbitration Rules and Procedures, and governed by the Federal Arbitration Act ("FAA"). The arbitration shall be conducted by a single arbitrator.
14.3. Location. Arbitration hearings shall take place in Miami, Florida, unless the arbitrator determines that such location is unreasonably burdensome to you, in which case hearings may be conducted by teleconference, videoconference, or at another mutually agreed location.
14.4. Class Action and Jury Trial Waiver. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND R3TA LLC EACH WAIVE THE RIGHT TO A TRIAL BY JURY. YOU AND R3TA LLC ALSO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
14.5. Exceptions. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction for matters involving intellectual property rights, unauthorized use of Products, misuse of confidential information, or any other matter where equitable relief is necessary to prevent irreparable harm.
14.6. Statute of Limitations. Any claim arising under or related to these Terms must be filed within one (1) year after the cause of action accrues, or such claim shall be permanently barred, to the fullest extent permitted by applicable law.
15. Governing Law and Jurisdiction
These Terms and any disputes arising out of or related to these Terms, the Website, Products, or Services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. To the extent any claim or dispute is not subject to arbitration as set forth in Section 14, you consent to the exclusive personal jurisdiction and venue of the state and federal courts located in Miami Dade County, Florida, and you waive any objection to such jurisdiction or venue.
16. Modifications to These Terms
16.1. R3TA reserves the right to update, amend, or modify these Terms at any time to ensure compliance with applicable laws and regulations, to improve your experience, or as otherwise determined by us. Material changes will be communicated by posting an updated version of these Terms on the Website with a revised "Last Updated" date and, where practicable, by providing at least thirty (30) days' advance notice via email or prominent notice on the Website before the changes become effective.
16.2. Changes to the dispute resolution provisions in Sections 14 and 15 will not apply retroactively to disputes that were notified by you to us, or by us to you, prior to the posting date of the changes.
16.3. Your continued use of the Website or Services after the effective date of any updated Terms constitutes your acceptance of and agreement to be bound by the modified Terms. If you do not agree to the updated Terms, you must discontinue use of the Website and may request closure of your Account prior to the effective date.

18. Force Majeure
R3TA shall not be liable for any failure or delay in the performance of its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to: natural disasters, pandemics or epidemics, government actions or regulations, supply chain disruptions, labor strikes or shortages, acts of terrorism or war, internet or telecommunications failures, banking or payment processor disruptions, carrier delays, or utility outages ("Force Majeure Event"). In the event of a Force Majeure Event, R3TA will use commercially reasonable efforts to resume performance as soon as practicable and will communicate material delays to affected Users.
19. Regulatory Compliance
